Agreement to Terms

By accessing or using Strua ("the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use Strua.

1. Description of Service

What Strua Is

Strua is a self-help mental health toolkit that provides:

  • 20 evidence-based techniques for building emotional resilience

  • 5 guided meditation recordings

  • Progress tracking tools (stored on your device)

  • Ability to create custom tools

  • Educational content about mental health techniques

What Strua Is NOT

Strua is NOT:

  • ❌ Medical advice, diagnosis, or treatment

  • ❌ Therapy or counseling services

  • ❌ A substitute for professional mental health care

  • ❌ Crisis intervention or emergency services

  • ❌ A HIPAA-covered entity or medical provider

  • ❌ Supervised by a licensed therapist (it's self-directed)

IF YOU ARE IN CRISIS:

  • Call or text 988 (Suicide & Crisis Lifeline)

  • Text HOME to 741741 (Crisis Text Line)

  • Call 911 for emergencies

  • Go to your nearest emergency room

Do not rely on Strua for crisis support.


2. Eligibility

Age Requirement

You must be at least 13 years old to use Strua.

If you are between 13-17 years old, you must have parental or guardian consent to use Strua.

Mental Health Status

Strua is designed for individuals seeking self-help tools for everyday stress, anxiety, and emotional regulation.

Strua may NOT be appropriate if you:

  • Are experiencing a mental health crisis

  • Have been diagnosed with severe mental illness requiring clinical supervision

  • Are at risk of harm to yourself or others

  • Require crisis intervention services

Please consult a qualified mental health professional to determine if self-help tools are appropriate for your situation.

Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your password

  • All activities that occur under your account

  • Notifying us immediately of unauthorized access


3. User Accounts

Account Creation

To access certain features, you must create an account by providing:

  • Valid email address

  • Secure password

You agree to:

  • Provide accurate, current information

  • Update your information if it changes

  • Not share your account credentials

  • Not create multiple accounts for the same person

  • Not impersonate others

Account Security

You are solely responsible for maintaining account security. We are not liable for any loss or damage from your failure to secure your account.

Account Termination

You may delete your account at any time through app settings or by contacting Dr.G@strua.app.

We reserve the right to suspend or terminate your account if you violate these Terms.


4. Subscriptions and Payments

Subscription Tiers

Free Tier:

  • Access to 7 core tools

  • Tool of the Day (rotating access to premium tools)

  • 2 guided meditations

  • Pin up to 3 favorite tools

  • Create 1 custom tool

  • Basic progress tracking (device-only)

Pro Tier ($9.99/month or $79.99/year):

  • All 20 tools (unlimited access)

  • All 5 guided meditations

  • Unlimited pinning

  • Unlimited custom tools

  • Advanced progress tracking

  • Export data functionality

  • Priority customer support

Lifetime Tier ($149 - Early Adopter Offer):

  • Everything in Pro tier

  • One-time payment, lifetime access

  • All future updates included

  • Limited availability (first 1,000 users)

Payment Processing

Payments are processed securely by Stripe, our third-party payment processor.

By subscribing, you authorize us to charge your payment method:

  • Monthly (for monthly subscriptions) on the day you subscribed

  • Annually (for annual subscriptions) on the anniversary of your subscription

  • One-time (for Lifetime tier)

Automatic Renewal

Monthly and Annual subscriptions automatically renew unless you cancel before the renewal date.

You can cancel anytime in account settings. Cancellation takes effect at the end of your current billing period.

Refund Policy

7-Day Money-Back Guarantee:

  • If you're unsatisfied within 7 days of purchase, contact Dr.G@strua.app for a full refund

  • Applies to first-time Pro or Lifetime purchases only

  • Does not apply to renewals

After 7 Days:

  • Subscriptions are generally non-refundable

  • We may offer refunds at our discretion for:

    • Billing errors

    • Technical issues preventing use of the service

    • Other extenuating circumstances

To request a refund: Email Dr.G@strua.app with your account email and reason for refund request.

Price Changes

We may change subscription prices at any time. Price changes will:

  • Not affect your current billing period

  • Take effect at your next renewal

  • Be communicated via email at least 30 days in advance

You may cancel before the price increase takes effect.

Taxes

Prices do not include applicable sales tax, VAT, or other taxes. You are responsible for any taxes based on your location.


5. Acceptable Use

You Agree NOT To:

Prohibited Activities:

  • ❌ Violate any laws or regulations

  • ❌ Infringe on intellectual property rights

  • ❌ Upload malicious code, viruses, or malware

  • ❌ Attempt to hack, reverse engineer, or compromise the Service

  • ❌ Scrape, copy, or download content for commercial purposes

  • ❌ Impersonate others or provide false information

  • ❌ Harass, threaten, or harm others

  • ❌ Use the Service for any illegal purpose

  • ❌ Spam or send unsolicited communications

  • ❌ Interfere with other users' access to the Service

  • ❌ Use automated tools (bots, scrapers) without permission

  • ❌ Resell or redistribute Strua content without authorization

  • ❌ Share your Pro account with others (one account per user)

Consequences

Violation of these Terms may result in:

  • Account suspension or termination

  • Loss of access to paid features (no refund)

  • Legal action if necessary


6. Intellectual Property

Our Content

All content on Strua is owned by us or our licensors, including:

  • Tool descriptions and instructions

  • Guided meditation recordings

  • App design and user interface

  • Educational content and research citations

  • Strua name, logo, and branding

This content is protected by copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use Strua for personal, non-commercial purposes

  • Download content to your device for personal use

  • Export your own data (progress tracking, custom tools)

Restrictions

You may NOT:

  • Reproduce, distribute, or display our content publicly

  • Create derivative works

  • Remove copyright or attribution notices

  • Use our content for commercial purposes without written permission

Your Content

You retain ownership of content you create (custom tools, notes, etc.).

By creating content in Strua, you grant us a limited license to:

  • Store your content on your device (we don't store it on our servers)

  • Display your content back to you in the app

We do NOT claim ownership of your content, and we do NOT use it for any other purpose.

Research Citations

Tool descriptions include research citations. These citations are for educational purposes under fair use doctrine. We do not claim ownership of the cited research.

Feedback

If you provide feedback, suggestions, or ideas about Strua, you grant us the right to use that feedback without compensation or attribution.


7. Disclaimers

Medical Disclaimer

CRITICAL: READ CAREFULLY

STRUA IS NOT MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The techniques, tools, and information provided through Strua are for educational and self-help purposes only. They are not intended to:

  • Replace professional medical or mental health care

  • Diagnose or treat any medical or mental health condition

  • Provide therapy or counseling

  • Serve as crisis intervention

Strua is a self-directed wellness tool, not a medical device.

Consult Professionals

You should always consult with qualified healthcare professionals regarding:

  • Diagnosis or treatment of medical conditions

  • Starting or stopping medications

  • Mental health concerns

  • Any health-related questions or decisions

Not a Substitute for Therapy

If you are currently in therapy, Strua is designed to supplement your treatment, not replace it. Always follow your therapist's guidance and discuss any new techniques with them.

No Doctor-Patient Relationship

Use of Strua does NOT create a doctor-patient, therapist-client, or any other professional relationship between you and:

  • The creators of Strua

  • Dr. G (the creator)

  • Any healthcare professionals

Emergency Situations

IF YOU ARE EXPERIENCING A MENTAL HEALTH CRISIS OR EMERGENCY:

  • Call or text 988 (Suicide & Crisis Lifeline)

  • Text HOME to 741741 (Crisis Text Line)

  • Call 911

  • Go to your nearest emergency room

Do not use Strua in crisis situations.

Evidence-Based ≠ Medical Advice

While Strua tools are based on evidence-based therapeutic modalities (CBT, DBT, MBSR, CBT-I), their inclusion in Strua does not constitute medical advice or professional treatment.

These techniques are simplified for self-help use and may not be appropriate for all individuals or conditions.

Results Not Guaranteed

We make no guarantees about the effectiveness of any tool or technique. Results vary by individual.

Some people may not experience benefits, and some techniques may not be appropriate for certain conditions.

Service Availability

"AS IS" and "AS AVAILABLE"

Strua is provided on an "as is" and "as available" basis without warranties of any kind.

We do not guarantee that:

  • The Service will be uninterrupted, error-free, or secure

  • Tools or content will meet your specific needs

  • Any errors or bugs will be corrected

  • The Service will be available at all times

No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy, reliability, or completeness of content


8. Limitation of Liability

Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or use

  • Personal injury or emotional distress

  • Failure to achieve desired results

  • Reliance on content or tools

  • Interruptions or errors in the Service

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Cap on Damages

Our total liability to you for any claim arising from your use of Strua shall not exceed:

  • The amount you paid to us in the 12 months before the claim, OR

  • $100 (whichever is greater)

Exceptions

Some jurisdictions do not allow limitation of liability for personal injury or certain other damages. If these laws apply to you, some or all of the above limitations may not apply.

Your Responsibility

YOU ASSUME ALL RISK ASSOCIATED WITH USING STRUA, INCLUDING:

  • Determining whether self-help tools are appropriate for your situation

  • Any decisions you make based on Strua content

  • Practicing techniques safely

  • Seeking professional help when needed


9. Indemnification

You agree to indemnify, defend, and hold harmless Strua, its creator (Dr. G), and any affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of Strua

  • Your violation of these Terms

  • Your violation of any law or third-party rights

  • Content you create or submit

  • Your reliance on Strua content


10. Data and Privacy

Privacy Policy

Your use of Strua is also governed by our Privacy Policy, available at strua.app/privacy.

By using Strua, you consent to our data practices as described in the Privacy Policy.

Device-Only Storage

Important: Your progress tracking data, custom tools, and usage history are stored ONLY on your device.

We do NOT have access to this data. If you delete the app or lose your device, this data will be lost unless you've exported it.

We are NOT responsible for data loss due to:

  • Device loss, theft, or damage

  • App deletion

  • Device storage issues

  • Operating system updates

  • Any other reason

Pro users: We recommend regularly exporting your data as backup.

Data Export

Pro users can export their device-stored data (progress, custom tools) as CSV or PDF files.

This exported data is YOUR responsibility to store and backup.


11. Modifications to Service

We reserve the right to:

  • Modify, suspend, or discontinue any part of Strua at any time

  • Change features, tools, or content

  • Update the app or website

  • Add or remove functionality

We will make reasonable efforts to notify users of significant changes, but we are not obligated to do so.

We are not liable for any modifications, suspensions, or discontinuations of the Service.

Feature Changes for Paid Users

If we remove a major feature from a paid subscription tier, we will:

  • Notify you via email

  • Offer a comparable replacement feature, OR

  • Provide a pro-rated refund for the affected portion of your subscription


12. Termination

Termination by You

You may terminate your account at any time by:

Upon termination:

  • Your access to Pro features ends immediately (or at end of billing period if you cancel before renewal)

  • Your account data will be deleted within 30 days

  • Device-stored data (progress, custom tools) is deleted when you uninstall the app

Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms

  • You engage in fraudulent activity

  • We are required to do so by law

  • We discontinue the Service

Upon termination by us:

  • You lose access to your account and Pro features

  • You are not entitled to a refund (unless termination was due to our error)

Effect of Termination

Upon termination (by either party):

  • Your license to use Strua ends immediately

  • Sections of these Terms that should survive termination will remain in effect (Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution)


13. Dispute Resolution

Informal Resolution

Before filing any legal claim, you agree to first contact us at Dr.G@strua.app to attempt to resolve the dispute informally.

We will work in good faith to resolve the issue within 30 days.

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

Jurisdiction

Any legal action or proceeding arising from these Terms or your use of Strua shall be brought exclusively in the state or federal courts located in Florida.

You consent to the jurisdiction of these courts and waive any objection to venue.

Arbitration (Optional - You Can Choose)

For any dispute that cannot be resolved informally, you may choose:

  1. Binding arbitration under the American Arbitration Association (AAA) rules, OR

  2. Small claims court (if the claim qualifies), OR

  3. Court litigation in Florida courts

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action or representative proceeding.


14. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Strua.

They supersede any prior agreements or understandings.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

Assignment

You may not assign or transfer these Terms to anyone else.

We may assign our rights and obligations to another entity (e.g., if we are acquired).

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (natural disasters, war, strikes, pandemics, government actions, etc.).

Headings

Section headings are for convenience only and do not affect interpretation of these Terms.

Language

These Terms are written in English. Any translations are for convenience only. The English version governs in case of conflict.


15. Changes to Terms

We may update these Terms at any time to reflect:

  • Changes in our practices

  • Changes in legal requirements

  • New features or services

How We Notify You

  • Post updated Terms on our website with new "Last Updated" date

  • Send email notification for material changes

  • Require acceptance of new Terms on next login (for significant changes)

Your Acceptance

Continued use of Strua after Terms changes constitutes acceptance of the updated Terms.

If you do not agree to the new Terms, you must stop using Strua and delete your account.

✓ You will not use Strua in crisis situations
✓ You are responsible for your own safety and well-being
✓ You accept the risks and limitations described in these Terms
